Terms & Conditions

Last updated: 25 October 2026

These Terms & Conditions (“Terms”) govern access to and use of Qbitlabs, the cloud-based laboratory information system available at qibitlabs.com, together with its related applications and services (the “Services”). By creating an account, starting a trial or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Definitions

  • “Qbitlabs”, “we”, “us” means the provider of the Services.
  • “Customer”, “you” means the laboratory, clinic or organisation that registers for the Services, and the person accepting these Terms on its behalf.
  • “Authorised Users” means your staff and others you allow to use the Services under your account.
  • “Customer Data” means all data entered into the Services by you or your Authorised Users, including patient information, test results, reports and billing records.
  • “Subscription” means the plan you purchase, its features and limits, and its period.

2. Eligibility and account registration

You must be at least 18 years old and legally able to enter into a contract. If you register on behalf of an organisation, you confirm you are authorised to bind it. You must give accurate registration details and keep them up to date. You are responsible for keeping login credentials confidential and for all activity under your account, including by your Authorised Users. Tell us immediately at adityakalmekh@qibitlabs.com if you suspect unauthorised access.

3. Free trial, subscription, fees and payment

  • New organisations receive a 7-day free trial. No payment is required to start it.
  • When the trial ends, access to the Services is paused until a Subscription is purchased. Available plans and prices are shown inside the application at that point.
  • Subscriptions are paid in advance for the selected period, in Indian Rupees, through our payment partner. Applicable taxes are shown before payment. We do not receive or store your card, UPI or bank credentials.
  • Subscriptions do not renew automatically. If a Subscription expires without renewal, access is paused; your Customer Data is kept and becomes available again on renewal.
  • Fees are non-refundable except as stated in our Cancellation & Refund Policy.
  • We may change our prices. A change does not affect a Subscription period already paid for.

4. Licence to use the Services

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable right for your Authorised Users to use the Services for your internal laboratory operations during your trial or Subscription.

5. Customer Data and patient information

You own your Customer Data. We process it only to provide, secure and support the Services, as described in our Privacy Policy. You are responsible for the accuracy of Customer Data and for having a lawful basis, including any patient consent required under applicable law, to collect and enter it. You may request an export of your Customer Data while your account exists.

6. Acceptable use

You agree not to:

  • use the Services for any unlawful purpose or to store data you have no right to hold;
  • attempt to access another customer’s data, or bypass security measures or plan limits;
  • disrupt, overload or probe the Services for vulnerabilities without our written consent;
  • copy, resell, sublicense or reverse-engineer the Services, except where the law permits;
  • upload malicious code or content that infringes the rights of others.

We may suspend access that breaches this section, with notice where reasonably possible.

7. Intellectual property

The Services, software, design and Qbitlabs name and logo are our property and are protected by law. These Terms grant no rights in them other than the licence in section 4. Your laboratory’s name, logo and letterhead remain yours. If you send us feedback or suggestions, we may use them without obligation to you.

8. Third-party services and integrations

The Services may connect to third-party products, such as payment gateways, messaging services and laboratory analyzers. Your use of those products is governed by their own terms, and we are not responsible for their availability or conduct.

9. Communications

By registering, you agree that we may contact you by email, phone, SMS or WhatsApp about your account, Subscription, service updates and offers. You can opt out of promotional messages at any time by writing to adityakalmekh@qibitlabs.com; service messages about your account will continue.

10. Service availability and support

We aim to keep the Services available at all times but do not guarantee uninterrupted or error-free operation. Maintenance is scheduled outside busy laboratory hours where possible. Support is available Monday to Saturday, 9:00 AM – 8:00 PM IST at adityakalmekh@qibitlabs.com.

11. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if you breach these Terms, fail to pay fees when due, or if required by law. After termination you may request an export of your Customer Data within 30 days, after which it may be deleted.

12. Disclaimer of warranties

The Services are provided “as is” and “as available”. Qbitlabs is a record-keeping and workflow tool and does not provide medical advice, diagnosis or treatment. Test results, reference ranges, automatically calculated values and report content must be reviewed by qualified staff, and all clinical decisions remain your sole responsibility.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, including loss of profits, revenue, goodwill or data, or for any clinical outcome based on reports produced with the Services. Our total liability for all claims relating to the Services is limited to the fees you paid us in the three (3) months before the event giving rise to the claim.

14. Indemnity

You agree to indemnify us against claims, losses and costs arising from your Customer Data, your use of the Services, or your breach of these Terms or applicable law.

15. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to section 16, the competent courts in India having jurisdiction over our principal place of business shall have exclusive jurisdiction.

16. Dispute resolution

Before starting any proceedings, the parties will try in good faith to resolve a dispute by negotiation for 30 days from written notice. Disputes not resolved this way shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, conducted in English.

17. Force majeure

Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, such as natural disasters, epidemics, government action, or failures of power, internet or hosting providers.

18. Changes to these Terms

We may update these Terms. The date at the top of this page shows the current version. We will notify you of material changes in the application or by email, and continued use after they take effect means you accept them.

19. Miscellaneous

These Terms, with the Privacy Policy and Cancellation & Refund Policy, form the entire agreement between you and us about the Services. If any provision is found unenforceable, the rest remain in effect. A failure to enforce a right is not a waiver of it. You may not assign these Terms without our consent; we may assign them as part of a reorganisation or sale of the business.

20. Contact information

For questions about these Terms, or to raise a grievance, write to adityakalmekh@qibitlabs.com. We acknowledge grievances within 48 hours and aim to resolve them within 30 days.
